Forklift Accident Lawyer in Las Vegas

Trial-Ready Representation After a Las Vegas Forklift Accident

A forklift accident can leave a worker facing serious injuries, missed work, and questions about which insurance system applies. At Cohan PLLC, we represent people whose lives have been upended by serious injuries and pursue accountability from the parties responsible.

We’re led by seasoned trial attorney Chasen Cohan, a Las Vegas native who understands local courts, insurance defenses, and community dynamics. We evaluate forklift injuries to determine whether workers’ compensation benefits, a third-party personal injury claim, or both may apply.

Call (702) 623-3579 for a free consultation about your forklift accident and the legal options that may apply.

How We Investigate Forklift Accident Claims

Our workplace accident attorney begins by reviewing where the accident happened, who controlled the work area, and whether anyone outside the employer contributed to the incident. That assessment helps us determine whether the matter may involve workers’ compensation, a personal injury claim against a third party, or two distinct claims.

Our investigation may include:

  • Official records: We review available police reports and other documentation concerning the incident.
  • Worksite evidence: We examine surveillance footage and witness statements that may show how the forklift was operated or how the area was managed.
  • Technical analysis: We use expert evaluations when specialized knowledge is needed to assess equipment, safety practices, or injuries.

We prepare qualifying injury claims with trial in mind from the outset. We pursue strategic negotiation when appropriate, but our preparation also accounts for the possibility that an insurer or responsible party will contest the claim.

Nevada Forklift Injury Reporting & Benefits

Prompt reporting matters after a workplace accident. Under Nevada Revised Statutes 616C.015, an injured employee generally must provide written notice as soon as practicable and within seven days after an accident. Nevada law includes exceptions, so the effect of delayed notice depends on the circumstances.

Nevada workers’ compensation materials and benefits may include:

  • Form C-1: The employee uses this form to provide notice of the injury or occupational disease.
  • Form C-4: An employee who receives medical treatment generally uses this form to file a claim for compensation.
  • Medical benefits: Covered care may be available for an eligible workplace injury.
  • Disability benefits: Wage replacement may include temporary total or temporary partial disability, while lasting impairments may qualify for permanent partial or permanent total disability benefits.
  • Additional benefits: Eligible claims may include vocational rehabilitation or death benefits for dependents.

An employee who has sought medical treatment generally must file a workers’ compensation claim within 90 days, subject to statutory exceptions. Eligibility and available benefits depend on the injury, medical findings, work status, and other claim-specific facts.

Appeal & Lawsuit Deadlines After a Forklift Injury

A denied claim or disputed benefit decision enters an administrative appeal process with separate deadlines. A claimant generally has 70 days to appeal an insurer’s written determination. A hearing officer’s decision generally may be appealed to an appeals officer within 30 days, subject to applicable rules and exceptions.

Those appeal periods aren’t the same as the deadline for filing a third-party personal injury lawsuit. Under Nevada Revised Statutes 11.190(4)(e), the general limitation period for a personal injury lawsuit is two years from the date of injury. Different rules may apply in some circumstances, and this general period shouldn’t be treated as the deadline for a claim involving a government entity.

Missing one deadline can affect a claim even when another legal path remains open. We review the accident date, reporting history, insurer correspondence, and potential third-party involvement to determine which path may apply.
